Court Receiverships and Court Referee Appointments
Court Receivers are Neutral Third Parties Appointed to Carry Out the Directives of a Court Order
Simply stated, when the division of real or personal property is in dispute, a neutral third party may be appointed by a judge to resolve the matter. This neutral third party is known as a court referee or a partition referee.
The court-appointed court referee / partition referee may be appointed to cases involving disputes among family members, partnerships, or spouses. They may also be appointed over cases where the ownership of the property is unknown or unclear. The appointment of the court referee is up to the discretion of the judge in the case.
The judge must interpret the partition case as it pertains to CCP 873.010 (a) which states, “The court shall appoint a referee to divide or sell the property as ordered by the court.” And CCP 873.210 which allows that the referee be “appointed through an interlocutory judgment.” The judge decides when and if a court referee will be appointed.
The judge may appoint a court or partition referee to “perform any acts necessary to exercise the authority conferred by this title or by order of this court,” according to CCP 873.060.

Kevin Singer is founder and president of Receivership Specialists, and with his business partners John Rachlin and Jackson Wyche, specializes in state and federal court receiverships, court partition referee assignments, partition sales, provisional director assignments, and bankruptcy trustee assignments.
Mr. Singer first started getting appointed as a rents & profits receiver due to his extensive real estate, property management and construction experience as founder and co-owner of a diversified real estate and consulting company. He is both a real estate broker and licensed building contractor.
Mr. Singer has served as a receiver, referee, and bankruptcy trustee over all different types of real estate, businesses, gas stations, hotels, assisted living facilities, restaurants, bars, liquor licenses, family estates/trusts, commodities, and construction projects. Mr. Singer is past president and on the board of directors for the California Receivers Forum (CRF), an Associate Publisher for Receivership News, seven time participant and panelist at the CRF in Conjunction with Loyola Law School Receivers Education Program. Mr. Singer lectures and writes on various topics in the receivership field.
